Shop724 INC., and/or its affiliates (“Shop724.ca”) provide website features and other products and services to you when you visit or shop at the shop724.ca site, use shop724.ca products or services provided by shop724.ca in connection with any of the foregoing (collectively, “shop724.ca Services”). Shop724.ca provides you access to this Site subject to the terms and conditions of this Agreement. Please note that your use of this Site constitutes your unconditional agreement to follow and be bound by these terms and conditions. Shop724 reserves the right to update or modify the Agreement at any time without prior notice. If the Agreement has been updated, Shop724.ca Canada will post the new Agreement on this Site and note the date that it was last updated. Your use of this Site following any such posting constitutes your unconditional agreement to follow and be bound by the Agreement as changed.

Trademarks
Graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Shop724.ca Service are trademarks or trade dress of Shop724 INC., or its affiliates, in Canada. Shop724 INC.’s trademarks and trade dress may not be used in connection with any product or service that is not Shop724 INC.’s or its affiliates’, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Shop724 INC. or its affiliates. All other trademarks not owned by Shop724 INC. or its affiliates that appear in any Shop724.ca Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Shop724.ca or its affiliates.
Licence and Access
Subject to your compliance with these Conditions of Use and your payment of any applicable fees, Shop724.ca or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and make personal and non-commercial use of the Shop724.ca Services. This licence does not include any resale or commercial use of any Shop724.ca Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Shop724.ca Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data-gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by Shop724.ca or its licensors, suppliers, publishers, rightsholders, or other content providers. No Shop724.ca Service, nor any part of any Shop724.ca Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Shop724.ca. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Shop724.ca without express written consent. You may not use any meta tags or any other “hidden text” utilizing Shop724.ca’s name or trademarks without the express written consent of Shop724.ca. You may not misuse the Shop724.ca Services. You may use the Shop724.ca Services only as permitted by law. The licenses granted by Shop724.ca terminate if you do not comply with these Conditions of Use or any Service Terms.
Website security
Users are prohibited from violating or attempting to violate the security of the Site, including, without limitation: (a) accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, “flooding”, “spamming”, “mailbombing” or “crashing”; (d) sending unsolicited email, including promotions and/or advertising of products or services; or (e) forging any header, including any email or TCP/IP packet header. Violations of system or network security may result in civil or criminal liability. Shop724.ca will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to scrape, navigate or search this Site other than the search engine and search agents available from Shop724.ca on this Site and other than generally available third party web browsers (e.g., Microsoft Explorer, Firefox, Chrome).
User Account
Each person may only create one Profile and the person who creates a User Profile is the only authorized person to access the Platform by means of said User Profile. The User is responsible for maintaining the confidentiality of any password or account number provided by the User or Shop724 in order to access the Platform. Every User is the sole responsible party for all the activities executed under their Profile or password. Shop724.ca is not under any obligation to verify the actual identity or authority of any user of a password and login name. Shop724.ca may rely on the authority of anyone accessing your account or using your password and will not be liable for any damages and expenses arising out of or relating to any unauthorized use of such account or password. You agree that you are responsible for all activities that occur on your account.
Shop724 has no control over the use of the User’s Profile and therefore disclaims all responsibility and liability relating to such use. If the User suspects a third party might be accessing the Platform through their User Profile or using their password, the User shall immediately notify Shop724 in writing by sending an email to [email protected]. By providing your telephone number you are granting express consent for Shop724 to make use of said number in order to make calls and send text messages for the corresponding provision of the Platform and Services.
Shop724 may suspend and/or delete any User Profile that is not created in accordance with these Terms of Use, including by providing false information, or by creating more than one Profile for one person.
The User acknowledges and agrees that a Seller or Deliverer may contact the User in relation to a Shopping Order, or the provision of Services relating to a Shopping Order, through any contact information provided in the User’s Profile, or through contact information the User provides directly to the Seller or Deliverer, or with a Shopping Order. Shop724 does not bear any responsibility or liability for any such contact between the User and any Shopper and/or Deliverer.
Should any Product in a Shopping Order not be available when a Seller is filling a Shopping Order, the Seller has the discretion to either contact the User to obtain instructions for a substitution for the unavailable Product, or Product to be included in the Shopping Order.
Payment
You understand that use of the Platform or the Services will result in charges to you for the Services or Products you receive through Shop724, a Shopper and/or a Deliverer (“Charges”). Shop724 will facilitate your payment of the applicable Charges on behalf of the Shopper or Deliverer as a payment service corollary to the principal Services provided. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the seller or Deliverer. Charges will be inclusive of applicable taxes where required by law, including GST/HST and PST. Charges paid by you are final and non-refundable, unless otherwise determined by Shop724 or by the applicable legislation.
All Charges are due immediately and payment will be facilitated by Shop724 using a payment method made available at Shop724’s discretion, after which Shop724 will send you a receipt by email. If your primary payment card or other payment method is found to be expired, invalid or otherwise not able to be charged, you agree that Shop724 may, as the seller’s or Deliverer’s as payment service provider, use another available payment card or method in your Profile.
As between you and Shop724, Shop724 reserves the right to establish, remove and/or revise Charges for any or all Services or Products obtained through the use of the Platform or Services at any time in Shop724’s sole discretion, but in all cases in accordance with the applicable legislation. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand or vary for each retail/grocery store available on Shop724. Shop724 will inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Profile regardless of your awareness of the amounts of such Charges. You may cancel your request for Services or Products at any time prior to payment for Products in a Shopping Order, in which case you may be charged a cancellation fee, unless prohibited by the applicable legislation.
This payment structure is intended to fully compensate Shop724, the seller and Deliverer for the Services and Products provided.
Reviews, Comments, Communications, and Other Content
Visitors may post reviews, comments, photos, and other content; send messages and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Shop724.ca reserves the right (but not the obligation) to remove or edit such content, but does not review all posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant Shop724.ca a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, produce, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, communicate to the public by telecommunications and display such content throughout the world in any media for all purposes, including in advertising and promotions. You grant Shop724.ca and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Shop724.ca for all claims resulting from content you supply. Shop724.ca has the right but not the obligation to monitor and edit or remove any activity or content. Shop724.ca takes no responsibility and assumes no liability for any content posted by you or any third party.
Intellectual Property Complaints
Shop724.ca respects the intellectual property of others. If you believe that your intellectual property rights are being infringed, please follow our Notice and Procedure for Making Claims of Copyright Infringement.
Risk of Loss
Risk of loss and title for items purchased from Shop724.ca pass to you upon our delivery to the carrier.
Returns, Refunds and Title
Shop724.ca does not take title to returned items until the item arrives at our fulfillment center or the seller’s center. At our discretion, a refund may be issued without requiring a return. In this situation, Shop724.ca does not take title to the refunded item. For more information about our returns and refunds, please see our RMA Center.
If a product you receive is in poor condition or it is wrong, please contact the seller or through the in-website seller messaging for more security so they can find you a solution. Refunds can be made in Shop724 credits or directly to the payment method used in the order at our discretion.
Refunds directly to the card may take 5 to 10 business days to be reflected in your account.
Returns are subject to the policies of each specific store and branch.
Product Descriptions
Shop724.ca attempts to be as accurate as possible. However, Shop724.ca does not warrant that product descriptions or other content of any Shop724.ca Service is accurate, complete, reliable, current, or error-free. If a product offered by Shop724.ca itself is not as described, your sole remedy is to return it in unused condition.
Pricing
“List Price” means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We regularly check List Prices against prices recently found on the Shop724.ca site and other retailers. Certain products may have a “Was Price” displayed, which is determined using recent price history of the product on the Shop724.ca site.
With respect to items sold by Shop724.ca, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.
We generally do not charge your credit card until after your order has entered the shipping process.
Other Businesses
Parties other than Shop724.ca operate stores, provide services, or sell product lines through the Shop724.ca Services. In addition, we provide links to the sites of affiliated companies and certain other businesses. If you purchase any of the products or services offered by these businesses or individuals, you are purchasing directly from those third parties, not from Shop724. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their web sites. Shop724.ca does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.
Shop724’s Liability Release
Shop724 will bear no responsibility at all for the acts or omissions of Shoppers or Deliverers, or of any Stores or Third-Party Providers, all of whom shall bear full responsibility for Services or other services they provide to Users.
Shop724 will not be liable for any complaint, injury or damage that may arise due to the acts or omissions of any Store, Shopper, Deliverer or Third-Party Provider, except the stated conditions set out in the previous paragraph. If a dispute arises with a Store, Shopper, Deliverer or Third-Party Provider, such dispute shall be between the User and such Store, Shopper, Deliverer and/or Third-Party Provider.
THE USER HEREBY RELEASES SHOP724, ITS DIRECTORS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES, OF ALL LIABILITY AND RESPONSIBILITY FOR ANY AND ALL COMPLAINTS, ACTIONS, PROCEEDINGS, COSTS, CLAIMS, DAMAGES, DEMANDS, AND EXPENSES INCLUDING BUT NOT LIMITED TO, LAWYER’S FEES OR LOSSES OF ANY KIND, WHETHER DIRECT OR INDIRECT, THAT MAY ARISE AS A CONSEQUENCE OF A DISPUTE BETWEEN A USER AND A STORE, SHOPPER, DELIVERER OR THIRD PARTY PROVIDER.
The User acknowledges and understands that Shop724 is no more than the mere facilitator, through providing use of the Platform, of the interaction between the User and Store, Shopper, Deliverer and Third Party Provider; and the User understands in no case is the User purchasing Products from Shop724, and that, should damages or infringement to User rights occur, such damages or infringement shall be a matter directly between the User and the Store, Shopper, Deliverer or Third Party Provider, and Shop724 shall not be involved or affected thereby in any way.
Note: There may be limited situations where services of a Shopper or Deliverer are provided by an employee of Shop724. In those circumstances Shop724 will be responsible to the extent imposed by applicable law. However, as these situations are rare, Users should not rely upon such a possibility.
Specific rules about purchases of alcohol, tobacco and vapour products or over-the-counter-medications
Shop724 is not licensed to deliver alcohol, cannabis, tobacco or vapour products. Shop724 does not deliver these items.
If any Shopping Order includes any Product that is an over-the-counter drug Product, the User orders and uses such Product entirely at the User’s own risk. The User is advised to contact a doctor to seek medical advice prior to ingesting or otherwise applying any over-the-counter drug Product for any reason.
NO CONTENT OF THE PLATFORM OR SHOP724 PROVIDES ANY MEDICAL ADVICE OR HEALTH INFORMATION. SHOP724 MAKES NO REPRESENTATIONS REGARDING ANY HEALTH BENEFITS, RISKS, OR HEALTH INFORMATION RELATING TO SUCH OVER-THE-COUNTER DRUG PRODUCTS, AND SHOP724, ITS DIRECTORS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES, THE SHOPPER AND THE DELIVERER SHALL HAVE NO RESPONSIBILITY OR LIABILITY FOR SUCH OVER-THE-COUNTER DRUG PRODUCTS AT ALL.
Applicable Law and Disputes
For Quebec consumers: These Conditions of Use and any dispute of any sort that might arise between you and Shop724.ca shall be governed by the laws of the Province of Quebec, without reference to its conflict of law’s provisions, and the laws of Canada applicable therein, and any disputes will be submitted to the courts of competent jurisdiction of the District of Montreal (Quebec).
Site Policies, Modification, and Severability
Please review our other policies, such as our pricing policy, posted on the Shop724.ca site. These policies also govern your use of Shop724.ca Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time.
