You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to scrape, navigate or search this Site other than the search engine and search agents available from Shop724.ca on this Site and other than generally available third party web browsers (e.g., Microsoft Explorer, Firefox, Chrome).

Each person may only create one Profile and the person who creates a User Profile is the only authorized person to access the Platform by means of said User Profile. The User is responsible for maintaining the confidentiality of any password or account number provided by the User or Shop724 in order to access the Platform. Every User is the sole responsible party for all the activities executed under their Profile or password. Shop724.ca is not under any obligation to verify the actual identity or authority of any user of a password and login name. Shop724.ca may rely on the authority of anyone accessing your account or using your password and will not be liable for any damages and expenses arising out of or relating to any unauthorized use of such account or password. You agree that you are responsible for all activities that occur on your account.
Shop724 has no control over the use of the User’s Profile and therefore disclaims all responsibility and liability relating to such use. If the User suspects a third party might be accessing the Platform through their User Profile or using their password, the User shall immediately notify Shop724 in writing by sending an email to [email protected]. By providing your telephone number you are granting express consent for Shop724 to make use of said number in order to make calls and send text messages for the corresponding provision of the Platform and Services.
Shop724 may suspend and/or delete any User Profile that is not created in accordance with these Terms of Use, including by providing false information, or by creating more than one Profile for one person.
The User acknowledges and agrees that a Seller or Deliverer may contact the User in relation to a Shopping Order, or the provision of Services relating to a Shopping Order, through any contact information provided in the User’s Profile, or through contact information the User provides directly to the Seller or Deliverer, or with a Shopping Order. Shop724 does not bear any responsibility or liability for any such contact between the User and any Shopper and/or Deliverer.
Should any Product in a Shopping Order not be available when a Seller is filling a Shopping Order, the Seller has the discretion to either contact the User to obtain instructions for a substitution for the unavailable Product, or Product to be included in the Shopping Order.
Paiement
You understand that use of the Platform or the Services will result in charges to you for the Services or Products you receive through Shop724, a Shopper and/or a Deliverer (“Charges”). Shop724 will facilitate your payment of the applicable Charges on behalf of the Shopper or Deliverer as a payment service corollary to the principal Services provided. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the seller or Deliverer. Charges will be inclusive of applicable taxes where required by law, including GST/HST and PST. Charges paid by you are final and non-refundable, unless otherwise determined by Shop724 or by the applicable legislation.
All Charges are due immediately and payment will be facilitated by Shop724 using a payment method made available at Shop724’s discretion, after which Shop724 will send you a receipt by email. If your primary payment card or other payment method is found to be expired, invalid or otherwise not able to be charged, you agree that Shop724 may, as the seller’s or Deliverer’s as payment service provider, use another available payment card or method in your Profile.
As between you and Shop724, Shop724 reserves the right to establish, remove and/or revise Charges for any or all Services or Products obtained through the use of the Platform or Services at any time in Shop724’s sole discretion, but in all cases in accordance with the applicable legislation. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand or vary for each retail/grocery store available on Shop724. Shop724 will inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Profile regardless of your awareness of the amounts of such Charges. You may cancel your request for Services or Products at any time prior to payment for Products in a Shopping Order, in which case you may be charged a cancellation fee, unless prohibited by the applicable legislation.
This payment structure is intended to fully compensate Shop724, the seller and Deliverer for the Services and Products provided.
Reviews, Comments, Communications, and Other Content
Visitors may post reviews, comments, photos, and other content; send messages and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Shop724.ca reserves the right (but not the obligation) to remove or edit such content, but does not review all posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant Shop724.ca a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, produce, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, communicate to the public by telecommunications and display such content throughout the world in any media for all purposes, including in advertising and promotions. You grant Shop724.ca and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Shop724.ca for all claims resulting from content you supply. Shop724.ca has the right but not the obligation to monitor and edit or remove any activity or content. Shop724.ca takes no responsibility and assumes no liability for any content posted by you or any third party.
Intellectual Property Complaints

Shop724.ca does not take title to returned items until the item arrives at our fulfillment center or the seller’s center. At our discretion, a refund may be issued without requiring a return. In this situation, Shop724.ca does not take title to the refunded item. For more information about our returns and refunds, please see our RMA Center.
If a product you receive is in poor condition or it is wrong, please contact the seller or through the in-website seller messaging for more security so they can find you a solution. Refunds can be made in Shop724 credits or directly to the payment method used in the order at our discretion.

Tarifs
“List Price” means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We regularly check List Prices against prices recently found on the Shop724.ca site and other retailers. Certain products may have a “Was Price” displayed, which is determined using recent price history of the product on the Shop724.ca site.
With respect to items sold by Shop724.ca, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.

Note: There may be limited situations where services of a Shopper or Deliverer are provided by an employee of Shop724. In those circumstances Shop724 will be responsible to the extent imposed by applicable law. However, as these situations are rare, Users should not rely upon such a possibility.

The User is advised to contact a doctor to seek medical advice prior to ingesting or otherwise applying any over-the-counter drug Product for any reason.
NO CONTENT OF THE PLATFORM OR SHOP724 PROVIDES ANY MEDICAL ADVICE OR HEALTH INFORMATION. SHOP724 MAKES NO REPRESENTATIONS REGARDING ANY HEALTH BENEFITS, RISKS, OR HEALTH INFORMATION RELATING TO SUCH OVER-THE-COUNTER DRUG PRODUCTS, AND SHOP724, ITS DIRECTORS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES, THE SHOPPER AND THE DELIVERER SHALL HAVE NO RESPONSIBILITY OR LIABILITY FOR SUCH OVER-THE-COUNTER DRUG PRODUCTS AT ALL.
